Nicodemus asks a simple but devastating question: Does our law condemn a person without first hearing what he has to say? He uses their own rules to expose their injustice.
The same leaders who just accused the crowd of not knowing the Law are caught violating it themselves. Nicodemus points this out without even mentioning Jesus by name.
Nicodemus speaks up in the council with a carefully worded challenge.
Sometimes the bravest thing you can do is ask a simple question. Nicodemus does not preach a sermon. He just holds up a mirror and lets the Pharisees see their own hypocrisy.
Nicodemus raises a procedural objection based on Torah: their own law does not condemn (krinei) a person without first hearing (akousē) from him and determining (gnō) what he has done, appealing to legal due process (cf. Deuteronomy 1:16-17).
Nicodemus does not directly defend Jesus but appeals to legal procedure, a wise strategy that exposes the council's abandonment of their own legal standards while minimizing his personal risk.
Nicodemus addresses the council with a legal objection, using the Law they claim to uphold to challenge their rush to judgment.
Nicodemus uses the Pharisees' own weapon against them. They accused the crowd of not knowing the Law, but it is the council that is violating it by condemning Jesus without a hearing.
49But this crowd that does not know the law—they are under a curse.”
50Nicodemus, who had gone to Jesus earlier and who himself was one of them, asked,
51“Does our law convict a man without first hearing from him to determine what he has done?”
52“Aren’t you also from Galilee?” they replied. “Look into it, and you will see that no prophet comes out of Galilee.”
53Then each went to his own home.
